Laws Governing Business Disputes
1. The type of law that is involved in relation to the case involves contract law. Simply, the business dispute between the plaintiff and the defendant is based on the assertion that the latter party engaged in violation of a contract for the supply of the plaintiff’s merchandise. Normally, contract law focuses specifically on the protection of parties involved in the respective legal agreements. In this case, the agreement legally enforces the performance of a promise or a collective of promises initiated by a single party to the other (Twomey and Jennings 242).
2. In this particular dispute, the form of law that is involved mainly comprises state law. Generally, every state possesses its own structure of regulations as well as courts that focus on the administration of several legal-based issues and problems (Twomey and Jennings 20). Business contracts are not the exception. In this respect, the Supreme Court of New York is responsible for handling the current contractual problem between the plaintiff and the defendant. With the defendant accused of breaching the contract, the respective court is responsible for mediating and deciding the fate of either party.
3. The main court that is hearing the business dispute comprises the New York Supreme Court. As asserted, issues such as business contracts are normally managed by courts and legal systems defined under state law. Since the case involves businesses based in New York, it is only right that the Supreme Court of the respective state attain participation in resolution of the pending matter.
4. Based on the case, it is possible to notice ethical issues, particularly on the part of the defendant. One of these issues mainly involves serving one’s own interests rather than those of the client. Apparently, the contract for merchandise supply failed to inform the main plaintiff of other businesses that were involved in the obligation. Interestingly, the businesses later discovered that they were considerable rivals within the respective market.
